WIPO国际设计申请的规范（10-13）

[專利專欄] WIPO國際設計申請的規範10/專利工程師蘇冠丞

    本主題繼續介紹世界智慧財產組織WIPO，其經手的「國際工業設計申請」中「圖式」的詳細規定。

成組設計的揭露

    「多個組件、零件」組合而成的「成組設計產品」的「圖式」，會是除了「整體組合的造型」之外，也必須清楚呈現「各組件的造型」，以及「各零件彼此的組合關係」。

    例如是下方圖1「組合箱體」的設計圖式中，只有呈現「整體組合的箱體(左、右)」及「內蓋(下)」，但「內蓋是如何組裝進整個箱體」的組合關係則「不明確」。另外，「箱體」有一面佈滿了「小黑洞」，但其詳細樣式也是難以辨認，因此「不明確」，也就「設計揭露不充分」。

    為了避免「設計揭露不充分」的情況，在向WIPO申請的「當日」會需要也提交像是下方圖2所示的這些「輔助圖」，以幫助「充足、完整揭露設計產品」。其中「部位放大圖Enlarged view (上圖)」可清楚呈現「黑洞的樣式」；「分解圖 Exploded view (左圖)」可呈現「全部的組件」；以及「剖面圖Cross-sectional view(右圖)」來呈現「詳細組合關係」。

視圖名稱必須恰當

    圖式中「各個視圖的命名」應該要「確實、恰當」，若是會造成混淆、誤解，則後來審查時也可能導致「核駁」。例如「6面視圖」中各視圖之間應該「尺寸相同、互相對應」，但像是上方圖1(上圖)這樣有將前視圖「尺寸放大」呈現的情況，就應該命名為「放大圖(enlarged view)」，否則後來可能導致「核駁」。

剖面圖的規範

    向WIPO提出「設計案」之後，若是指定「加拿大」、「日本」、「墨西哥」與「美國」等Hague締約國作申請，且「圖式」中有包含「剖面圖」的話，應該注意其詳細規範。對這些國家而言，「剖面圖」應該在「對應的視圖」中做「視覺性的標註」，也至少必須在「DM/1國際設計申請單」的「Description」欄位說明是「從何處切開的剖面」。

    例如是下面圖1的「立體圖(左圖)」加上「切割線A-A」，並且在「Description」欄位對「剖面圖(右圖)」說明：「A cross-sectional view taken through front to back center (從前方切割至後方中心的剖面圖)」。

立體陰影效果

    「設計圖式」中，「孔洞/凹槽」等部位，可能不易從「單純的線條輪廓」來確實判斷其形體，因此建議加上「陰影效果」。

    例如像上方圖2「藥錠」的設計，其「中央的圓」從4個視圖都無法判斷「孔洞」或「凹槽」，如此在「審查」時，也會基於「揭露不充分」而導致「核駁」。對此，可像下面圖3這樣加上簡單的「細線、淡線」來呈現「陰影效果」。則如圖所示，可看出中央的構造是「凹槽」，而不是「貫穿的孔洞」。

圖式中有不同形式

    向WIPO提出「國際設計申請」時，若申請的「圖式」有包含像是下方圖1這樣，同時包含「黑白線條圖」、「彩色圖繪」或「照片」等等「不同圖式呈現方式互相混雜」的情況，之後到「個別的締約組織/國家申請」的階段，在「審查」時可能會被認定「圖式彼此不對應(inconsistent)」。 如此，也就可能導致「核駁」，而必須另行修改、修正。

    另外，「加拿大」、「日本」與「羅馬尼亞(Romania)」等國在審查上，是除非圖式之間內容明顯不對應，否則基本上會「接受」不同圖式呈現方式互相混雜的情況。

WIPO申請圖式與文件對應範例

    在此用「藥錠」的外型設計，來舉例示範「國際設計申請」中「圖式」與「DM/1設計申請單」的對應標示法。

    首先，「圖式」中各視圖應該像下方圖2這樣標上「圖號(1.1/1.2/1.3…)」，其中「1.1」代表第1件設計產品的第1視圖」；「1.2」代表第1件設計產品的第2視圖，後續則如此類推。

    接著，在下方圖3「DM/1設計申請單」的「Description」欄位中應該有圖中「藍色處」的說明內容，如此來表明視圖1.1、1.3與1.4中「虛線部位」都「不請求」設計權益。另也註明此設計產品「前、後、左、右造型皆相同」，因而省略「後、左、右的視圖」。

    再來也應該在下方圖4「DM/1設計申請單」的「Legend」欄位中填寫「各視圖所對應的視角/種類編碼(code)」。

    在此，最後也將前面各個文章所介紹的「國際工業設計」的文件，以及圖式上的「應注意點」，配合WIPO針對幾個「締約國家」的「設計審查作法」而提供的「建議指標」，如此來做出以下的表格供方便參考。
